General terms and conditions
Ordering Process:
Order Placement: Orders can be placed through A1 Element's designated channels, such as the company website, email, or phone. All orders are subject to acceptance by A1 Element.
Pricing and Payment: Prices are as stated in the order confirmation, unless otherwise agreed upon or they were provided before. Payment terms, such as due date and accepted payment methods, will be specified before proceeding an order.
Quality: it is previously confirmed with a sample for verification before ordering, otherwise the customer assumes responsibility.
Order Confirmation: Upon receiving an order, A1 Element will provide an order confirmation detailing the products, quantities, pricing, and any additional terms or special conditions unless they were provided before.
Delivery:
Shipment: A1 Element will make reasonable efforts to ship products within the agreed-upon timeframe. Any delivery dates provided are estimates and not guaranteed unless otherwise explicitly stated in writing.
In the case of organizing transport by A1 Element and the possibility of not being present during the delivery of goods to the customer - the customer is obliged to inform in advance.
Shipping Charges: Unless otherwise specified, shipping charges will be the responsibility of the customer and will be added to the total invoice amount.
Loss or damage: Risk of loss or damage to the products transfer to the customer upon delivery. Any claims for loss or damage during transit should be urgently reported in accordance with the terms of delivery.
Product Acceptance and Inspection:
Inspection: The customer is responsible for inspecting the products upon delivery. Any visible defects, damages, or discrepancies must be reported to within 1 working day counting from the date of delivery.
Acceptance: Unless the customer notifies A1 Element of any non-conformity within the specified timeframe (5 working days), the products will be deemed accepted and in good condition.
Returns & refunds:
Returns: The customer has the right to return any product within 5 working days from the date of delivery, provided that the product is in its original condition, unopened, and in the same time suitable for resale. The customer is responsible for the cost of return shipping unless otherwise specified by A1 Element. It is recommended to use a reputable shipping carrier and obtain a tracking number for the returned package.
Refunds: Upon receiving and inspecting the returned product, A1 Element will initiate a refund.
Intellectual Property:
Ownership: A1 Element retains all intellectual property rights to its products, including patents, trademarks, copyrights, and trade secrets.
Usage: The customer agrees not to reproduce, modify, distribute, or use A1 Element's intellectual property without prior written consent.
Limitation of Liability:
A1 Element shall not be liable for any indirect, incidental, consequential, or special damages arising from the sale, use, or inability to use the products.
Termination:
Either party may terminate an order or agreement in the event of a material breach by the other party, subject to any specific termination provisions agreed upon between the parties.
Governing Law and Jurisdiction:
The terms and conditions of sale shall be governed by and construed in accordance with the laws of European law. Any disputes arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the it's courts.
Dispute Resolution:
In the event of a dispute regarding returns or refunds, both parties agree to make reasonable efforts to resolve the issue amicably. If a resolution cannot be reached, the matter may be escalated as per the agreed-upon dispute resolution process.
